As an attorney, Brad litigated and mediated employment discrimination, civil rights, personal injury and business and employment contract cases.  As Oregon’s Commissioner of Labor and Industries he oversaw thousands of employment cases and hundreds of mediations. 

Brad understands the importance of resolving conflicts as quickly, inexpensively and as favorably as possible for all parties involved. These three things are difficult to achieve in litigation.

What:

Mediation is a popular and successful way of resolving conflicts without the uncertainty and cost of litigation.  It is confidential, risk free and allows the parties the chance to craft their own solution to a dispute. In mediation, Brad spends considerable time with both parties, appreciating each of their perspectives. He also listens carefully to counsel, welcomes their opinions and facilitates a mediation that serves everyone’s needs. 

In arbitration, the parties choose to not have their case heard by a jury or judge and usually agree to forego any appeals process. Instead, they save expense and time by having an arbitrator decide their case. Brad listens carefully as both parties present their evidence and then applies the law to the facts. He always provides a written decision fully explaining his reasoning and conclusions.

Where:

Brad is available to mediate or arbitrate across Oregon and will provide services in your office or a suitable, neutral location. 

Rates:

Brad’s fee is $425 per hour for time spent in mediation/arbitration, preparing for either and for any necessary post mediation/arbitration work, plus reimbursement for reasonable expenses.

Except for appropriate lodging, Brad does not charge for travel expenses within Oregon.

If mediation/arbitration is cancelled, the parties are responsible only for the fees and reasonable expenses already incurred.

Payment is due within 15 days of billing. 

The participants are jointly and severally responsible for the fees and expenses.
